Terms of Service

These Terms of Service ("Terms") govern your access to and use of Praivon ("Service", "we", "us"). By creating an account or using our Service, you agree to these Terms.
1. Eligibility
You may use Praivon only if you:
- Are at least 18 years old
- Have the legal capacity to enter into a binding contract
- Are not prohibited from using the Service under applicable law
- Are protecting your own identity, OR have explicit legal authorization to protect another person's identity (parental/guardian rights, court order, signed authorization from the data subject)
2. Account responsibilities
- You are responsible for keeping your credentials secure
- You must notify us immediately of unauthorized access
- One person, one account — no shared accounts on individual tiers
- You are responsible for all activity on your account
3. The service
Praivon scans public platforms for content matching your identity fingerprint and assists with takedown requests. Important limitations:
- We cannot guarantee 100% removal of any content
- Some platforms (especially dark web, foreign jurisdictions) may not comply with takedown requests
- Detection accuracy depends on the quality of your biometric input
- We provide best-effort service, not absolute results
4. Subscription, billing, and immediate activation
Subscriptions are billed monthly or annually in advance via Stripe. By completing checkout, you authorize recurring billing until you cancel.
4.1 Immediate activation and consent to begin service
By activating your subscription, you explicitly consent to the immediate commencement of the digital service. You acknowledge and agree that:
- The service begins providing value immediately upon activation (scanning starts within minutes)
- Computational, infrastructure, and human resources are allocated to your account from the moment of activation
- You expressly waive your right of withdrawal under EU consumer law (Article 16(m) of Directive 2011/83/EU) for the portion of the service already performed
- This waiver applies only to the consumed portion; unconsumed portions remain subject to the refund terms below
5. Refunds
Our refund policy reflects the nature of digital identity protection services, which consume resources from the moment of activation:
5.1 Before activation
If you have paid but have NOT yet activated any scan or uploaded any biometric data, you may request a full refund within 14 days of payment. Contact billing@praivon.com.
5.2 After activation, within 14 days
Once you have activated the service, the portion already consumed (scans performed, takedowns initiated, infrastructure allocated) is non-refundable. You may, however, request a pro-rata refund for the unused portion of your subscription period within 14 days of payment.
Pro-rata calculation: (days remaining in billing period ÷ total days in billing period) × amount paid, minus any actual takedown costs incurred.
5.3 After 14 days
Outside the 14-day window, fees are non-refundable. You may cancel at any time to prevent future charges, but no refund is provided for the current billing period.
5.4 Custom / Enterprise plans
Custom plans are governed by individual contracts. The default position is no refunds unless otherwise stated in your contract.
5.5 Exceptions (we always refund)
Regardless of the rules above, we will issue a full refund if:
- Service is materially defective due to our fault
- Significant downtime (greater than 30 days) prevents service delivery
- We materially breach these Terms
- Required by an order from ANSPDCP, a court, or competent authority
6. Cancellation
You may cancel anytime from your dashboard. Your access continues until the end of the current billing period. Your data is preserved for 30 days, then permanently deleted. Biometric data is deleted immediately upon cancellation request.
7. Acceptable use
You may not use Praivon to:
- Protect an identity that is not yours and that you have no authorization to protect
- Submit false takedown requests in bad faith
- Interfere with the Service or other users
- Reverse engineer our systems
- Use our service to harass, defame, or violate the rights of third parties
Violation may result in immediate account termination without refund.
8. Limitation of liability
To the maximum extent permitted by law, Praivon's total liability for any claim is limited to the amount you paid us in the 12 months preceding the event giving rise to the claim.
We are not liable for: indirect damages, lost profits, reputational harm beyond our direct actions, or content that we were unable to remove despite good-faith efforts.
These limitations do not apply to liability for gross negligence, willful misconduct, or any other liability that cannot be limited under applicable law.
9. Termination by us
We may suspend or terminate your account if you:
- Violate these Terms
- Fail to pay
- Use the Service for unlawful purposes
If we terminate without cause, you receive a pro-rata refund of unused subscription.
10. Governing law
These Terms are governed by the laws of [Jurisdiction TBD by legal counsel], without regard to conflicts of law principles. Disputes will be resolved by competent courts in the EU. Consumers retain all mandatory rights under their national law.
11. Changes to these Terms
We may update these Terms. Material changes are notified via email and dashboard at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.
